Exclusive.. Al-Maqouri: Imposing or Cancelling Fees and Taxes Falls Under the Authority of the Cabinet, Not the Ministry of Economy
The official spokesperson of the Customs Authority, Fahmi Al-Maqouri, stated exclusively to our source that the Customs Authority has withdrawn the circular concerning the suspension of the collection of the additional duty on imports. This came after receiving a letter from the General Administration of Technical Affairs at the Customs Authority confirming that the imposition or cancellation of fees and taxes falls within the jurisdiction of the Cabinet, and not the Ministry of Economy.
He added that the imposition of taxes and fees is carried out based on a proposal submitted by the Minister of Finance, in accordance with Law No. 10 of 2010 and its executive regulations, specifically Article Five, as well as through a decision issued by the Cabinet. He emphasized that no individual sectoral authority has the independent power to cancel or suspend collection through correspondence or direct administrative decisions, stressing that such decisions are government matters governed by the applicable legal procedures.
Al-Maqouri explained that the Customs Authority is an executive body responsible for implementing all issued decisions. In the event that any decision is issued by the Prime Minister’s Office regarding exemptions or the cancellation of additional fee collections, it will be implemented immediately, as the authority serves as an executive body for all relevant institutions in accordance with applicable laws and regulations.
