Legal advisor \u201cHisham Al-Harati\u201d told Sada Economic exclusively: When property is violated, the authority of the law is put to the test. The issue is not a simple piece of land\u060c but a real test of the extent to which the law is respected in Libya. Property rights are not a favor, nor a privilege that can be granted or withdrawn; rather, they are a fundamental constitutional right affirmed by the Supreme Court in its ruling issued on December 23, 2013, when it stated that (property is protected and may not be infringed upon except in accordance with the law, for a genuine public benefit, and with fair compensation).<\/p>\n\n\n\n
He added that a serious incident is currently being raised regarding the seizure of land owned by the heirs of the Al-Tarhouni family in the Zawiyat Al-Dahmani area, without a clear legal basis and using the tools of a public entity. He considered this a violation of the law and an infringement of a constitutional right, opening the door to the return of practices that were supposed to have ended.<\/p>\n\n\n\n
He explained that any action that deprives an owner of their property without legal justification and fair compensation is considered null and void, contrary to constitutional principles and rules, and even constitutes an abuse of power when used to achieve private interests at the expense of a constitutionally protected right.<\/p>\n\n\n\n
Al-Harati pointed out that what is more dangerous than the incident itself is what it reflects: a return to the logic of seizure and administrative overreach, which contradicts any discourse on transitional justice or institutional reform aimed at achieving a state governed by the rule of law. He stressed that \u201cthere is no stability without respect for property, and no trust in the state with the the continuation of these violations.\u201d<\/p>\n\n\n\n
He called for the immediate suspension of any unlawful actions, the opening of a clear and transparent investigation, and restoring matters to their proper course. He concluded by stating: a state that does not protect the property of its citizens undermines its own legitimacy.<\/p>\n\n\n\n
